What Is Domestic Violence?
Certain crimes are considered to be crimes of domestic violence. This label is put on regular crimes when the parties to the incident are related, co-habiting, parents of a joint child or involved in an intimate relationship. Domestic violence crimes include coercion, kidnapping, assault and harassment, among others. Conviction of a crime of domestic violence carries additional penalties. Examples may include a requirement that the defendant complete a domestic violence education program and/or anger management, pay additional fines, and have no contact with the victim or victim’s family.
Stalking And Restraining Orders
Alleged victims of domestic violence may obtain stalking or restraining orders against a person, and violation of those orders can constitute the basis for additional criminal charges.
If you are a respondent to a stalking order or restraining order, you must obey its terms, even if the person who obtained the order against you invites you over. The orders are issued by a judge and can only be dismissed by a judge. Before you take action on your own, talk to an experienced lawyer.
